Course Description

Are you aware of the controversial situations facing States and foreign investors nowadays in relation to, for instance, the protection of public health and the environment? Do you recall recent cases such as Philip Morris v Uruguay and Vattenfall v Germany?

In the aftermath of these high profile cases and in the context of the negotiation of new international investment agreements, like the CETA and the TPP, local populations, policy-makers and NGOs have come to realize the societal importance of international investment law. Passionate and sometimes ill-informed discussions have resulted from this realisation.

They have focused on the features of international investment law, which has traditionally granted rights to foreign investors to foster States’ economic development. Central to these discussions are the issues of:

  • the balance between the protection of foreign investors and the right of host States to regulate in order to protect public welfare objectives;
  • the duties and obligations of foreign investors;
  • the promotion of sustainable development in international investment law;
  • the legitimacy of arbitration tribunals to decide on disputes between host States and foreign investors;
  • the coherence of arbitration practice.

Learning and understanding the features and dynamics of international investment law is key not only for international lawyers and policy-makers, but it is also important knowledge for all well-informed citizens.

In this law course, you will:

  • discover the history of international investment law and understand the dynamics which shape its evolution;
  • learn the objectives of international investment law and the specific rights international investment agreements grant to foreign investors;
  • discover how those rights have been interpreted by arbitration tribunals;
  • master the features and functions of investor-state arbitration;
  • understand why international investment law and investor-state arbitration are currently the subject of criticism and be able to assess the soundness of this criticism;
  • gain insight into the content of treaties newly concluded, and be able to assess how they address the issues of the right of host States to regulate, of foreign investors’ obligations and of the legitimacy of arbitration tribunals.

instructor has a deep knowledge of the subject, but still manages to explain in clear terms. course itself is excellent as well, methodically, well organised and providing both the basic knowledge as well as some insight in the most challenging disputes of the day, However, method of questioning is horrible; all points on very few, over-complicated questions, incomprehensible texts, imperfect grammar and many 'multi-opts' make that no right answer can be given. My recommendation, never do the verified track, you never make the 60 pts which means certainly money lost!!

the course gave me insights into all aspects of IIL, even though I have not fully absorbed all knowledge and documents conveyed in this course but this will be the foundation for my digging deeper later. I highly appreciate what MOOC contributed to the international community through this course, especially thanks to Instructor, Provider.

course very ilustrative, although the questions not well formulated in my opinion in this matter of international investment law the subjectivity is quite large, so a great effort by the teacher is developed in order to cope with that. on the other hand, the exposure of the subjects are generally well done although i would better appreciate a better interconection between some iusses: for example, when talking about indirect expropiation and compensation which are treated in different modules. in general i have enjoyed the course and i acknowledge the effort of the ponent with the time limitations and the integration between the treaties (teoretical) and the awards (practical) aspects

Currently undertaking the course and, while I find the content informative, the structure of the exams is the worst I have experienced. I certainly understand making what is essentially an open book exam a more difficult, but it truly feels like there is an attempt to trick students out of points with negative formatting, vague questioning, and several right answers (5 options, 4 are right, miss out on 1 and the entire point is lost), as well as providing simply not enough time to complete it. It doesn't bode well for education when the questions are seemingly worded in a way as to trick the student as opposed to genuinely determining whether they have a firm grasp on the subject knowledge of the course. Unverified, I would rank this highly. If you choose to verify, expect to have a very difficult time passing, regardless of how many times you reread the material.

I did not have any previous background on this field. The MOOC has been clear and it gave me the basic informations in order to understand also some issues related to certain aspects. Specially the latter has been useful, since it represented the possibility to think by myself about some topics which are currently disputed.

First experience about international investment law (IIL). It is a really interesting field of the international law! The course is rather short, but it gives you the fundamentals and makes you want to get to know better the IIL. And, yes, there are a lot of complementary readings you can download and read for yourself!

Enjoyed the course very much. Prof. Yannick and his team provide a very well structured and detailed introduction into International Investment Law. The questions on the tests are not trivial to say the least as I have become to expect also from the other courses in the International Law series. Highly recommended!

This course has provided a fresh insight into the development of responses to the arbitrary and insular ways that ISDS has been conducted historically in the experience of Canadians. It is very encouraging that IIL has been pathfinding so that SRO self regulation organization governance can learn from it within countries.
